General Terms and Conditions for access to casinotip.com

1. Introductory provision
   1. For the purposes of these General Terms and Conditions, the following terms shall have the following meanings:
      “Copyright Act” means Act No. 121/2000 Coll., on Copyright, on Rights Related to Copyright and on Amendments to Certain Acts (Copyright Act), as amended,
      “Civil Code” means Act No. 89/2012 Coll., the Civil Code, as amended,
      “Terms” means these Terms and Conditions and the provisions set out in the relevant sections of the Website to which these Terms and Conditions refer. Where these Terms refer to the Terms, it shall also mean the Personal Data Processing Terms, unless the context of such provision or reference indicates otherwise,
      “Personal Data Processing Terms and Conditions” means the terms and conditions on the processing of personal data pursuant to Act No. 101/2000 Coll., on the Protection of Personal Data and on Amendments to Certain Acts, as amended, and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), which form part of these Terms and Conditions and are set out in a separate document,
      “Operator” means AFFILMASTER ONLINE s.r.o. of Vojtěšská 211/6,, Prague, ID: 17972582
      “Capable person” means a natural person who has attained the age of 18 years and is fully capable of exercising his or her legal capacity under the Civil Code (i.e. his or her legal capacity is not limited and his or her mental and volitional maturity reaches the mental and volitional maturity of an adult), and if the natural person is not a citizen of the Czech Republic, then he or she must be fully capable of exercising his or her legal capacity in accordance with the law of the state of which he or she is a citizen,
      “User” means the person who uses the Website,
      “Website” means the casinotip.com website operated by the Operator and available at the internet address (URL) casinotip.com in the footer of the Website.
      
      
2. Basic provisions
   1. The Operator operates a Website where it provides Users with independent information regarding gambling, in particular in online casinos, or other online games, as well as information regarding individual websites where gambling or other games are accessible.
   2. The operator expressly points out that
      1. is not an online gambling provider,
      2. all information on the Website is for informational purposes only and the Operator cannot guarantee the accuracy of the information made available,
      3. The Website contains links to external third-party sites, the content of which cannot be influenced by the Operator,
      4. the information made available on the Website cannot be regarded as advice of any kind,
      5. any participation in gambling may be for entertainment purposes only and cannot be a source of funds similar to the derivation of income from a dependent, self-employed or other similar activity,
      6. Participation in gambling is not possible for persons under the age of 18, and “The Ministry of Finance warns: participation in gambling can lead to addiction!”.
   3. These Terms and Conditions govern in particular the relationship between the User and the Operator when using the Website and the rules that Users must follow when using the Website.
      
      
3. Access to the Web
   1. Access to or use of the Website is prohibited for persons who are not Legal Persons. By accessing the Website, the User confirms that he/she is an Authorized Person. It is the User’s sole responsibility to determine whether it is legal for him or her to participate in online gambling in his or her jurisdiction.
      1. Access to the Website is only possible by filling in the required data (in particular, e-mail address) and confirming your acceptance of the Terms. Confirmation of acceptance of the Terms is only required once and is no longer required for subsequent access to the Website. The User is obliged to provide only correct, true and accurate information when accessing the Website.
   2. The Operator is entitled to refuse access to the Website or restrict access to the Website for any person (in particular, if the person is not a Legal Entity, the person has violated a legal obligation to the Operator in contract or under generally binding legal regulations).
      
4. User’s rights and obligations when using the Website
   1. By accessing the Website, Users are bound by these Terms and Conditions (including the Personal Data Processing Terms and Conditions) and are obliged to comply fully with them.
   2. The User agrees that:
      1. will comply with all obligations laid down by generally binding legal regulations,
      2. not allow a third party who is not an Authorised Person to access the Website,
      3. not to infringe the intellectual property (copyrights, trademarks, patents, etc.) of the Operator or third parties, in particular not to access, publish, copy, distribute, misuse or in any way use content, i.e. materials, audio-visual recordings, etc., which is protected in particular by the Copyright Act or other generally binding legal regulations, without the consent or appropriate license.
   3. The User further agrees that when using the Website, he/she will not use:
      1. Defamatory, offensive, inflammatory or socially unacceptable references, comments, phrases, words or graphic or other gestures regarding religion, race, sexual orientation, gender, or other target groups, or which may infringe on a person’s personality rights (personality, dignity, honour, respectability, privacy, expressions of a personal nature, bodily integrity) or be in any way threatening or derogatory in nature, in particular if such reference or comment is likely to cause harm to the individual or target group,
      2. Realistic portrayals of people or animals being killed, maimed, tortured or abused, or any content that incites violence,
      3. depictions that promote the illegal or indiscriminate use of weapons and dangerous objects, or that facilitate the purchase or manufacture of weapons,
      4. inflammatory religious comments or inaccurate or misleading quotations of religious texts,
      5. false information and characteristics about the User, whereby the User must not impersonate another person, publishing content that does not belong to the User’s true identity,
      6. offensive political or religious views, including the extreme use of national or religious symbols,
      7. any enticement to abuse addictive or life-threatening substances or to promote or encourage the abuse of such substances,
      8. content that is an alarmist message that is false,
      9. content which is a pornographic work, which in particular depicts a child, or which shows violence or disrespect for human beings, or which depicts sexual intercourse with an animal; and
      10. content that would encourage criminal conduct or conduct contrary to generally binding legal regulations.
   4. Furthermore, the user must not:
      1. advertise, indicate, publish addresses of other websites that are similar to the Website and advertise, indicate and publish advertisements and other messages close to their nature, the User is not entitled to advertise in any way another entrepreneur in a competitive relationship with the Operator, to publish material that could damage the reputation of the Operator,
      2. endanger others by installing computer viruses or other malicious software or by sending excessive batches of messages, notifications and other communications; the User must not interfere in any way with the content of the Website, in particular by endangering or disrupting its operation or by illegally obtaining personal data about other Users; and
      3. use the Site to sell goods, services or distribute promotional materials.
   5. The User warrants that he/she is the sole author of the data published or made available by him/her on the Website or in his/her user account, or that he/she has the appropriate license to the data published or made available on the Website, and that he/she is entitled to publish, distribute and deal in any way with the content posted on the Website and in his/her user account, i.e. In particular, photographs, audio-visual works or any electronic files and information, to the extent necessary, and that such content is not encumbered by the rights of third parties, whereby if he enters data for the purpose of making it public, including texts, photographs, images, drawings, audio-visual juxtapositions, graphic creations or any electronic juxtapositions, he grants the Operator an unlimited royalty-free license to distribute, process, translate or modify such data.
   6. Users are obliged to familiarize themselves thoroughly with the terms and conditions for the use of third-party websites to which the Website links.
   7. Any abusive behaviour will not be tolerated and if such behaviour is detected, the Operator reserves the right to remove, edit or block any User’s thread or access at any time without prior notice.
   8. User messages posted on the Website express the views and opinions of individual Users and in no way reflect the views or opinions of the Operator. The Operator does not actively read or review User Submissions and therefore assumes no responsibility for the content of any User Submissions on the Site.
   9. The Operator reserves the right to disclose a User’s identity (or any other related information collected on the Site) to the appropriate authorities in the event that any formal complaint or legal action is initiated as a result of any User’s activity on the Forum, without the need to notify such User whose information is at issue.
   10. The Operator has the right, but not the obligation, to continuously monitor the content of the Website to ensure the operation of the Website. The User gives the Operator express permission for the User’s activity on the Website to be monitored at any time on a random basis, in particular to check whether the User complies with the Terms when accessing the Website. The Operator has the right, but is not obliged, to check the User.
   11. The Operator is not responsible for the content that the User or anyone else may post on the Website. The Operator reserves the right to delete, without prior notice, any such content that is or may be deemed inappropriate or contrary to these Terms and Conditions or generally applicable law, as well as the right to edit, modify, delete and ban any content that it deems otherwise objectionable. The Operator is entitled to restrict or delete, to any extent, access to or publication of any file, communication, posting that has been posted or made available on the Site or in a user account in violation of the Terms.
   12. The User acknowledges and agrees that all discussions, comments, ratings, messages within the Website are public and may be read without the User’s knowledge. All communication that will take place on the Website is considered public. By posting files, comments, messages, or other information on the Site or User accounts, the User grants the Operator the right to use such files, information, comments, and messages for advertising, promotional, market research, or other purposes as permitted by law.
       
5. Complaints

   2. The operator is obliged to settle the complaint within 30 days from the moment of delivery. The User is obliged to provide the Operator with all necessary cooperation. In the event that the claim is filed later, the User’s right to the settlement of the claim shall be extinguished. The Operator shall make a final decision on the claim.
      
      
6. Responsibility of the Operator
   1. In using the Website, the Operator is not responsible (i) for services provided by third parties, or (ii) for the actions of Users on the Website, such as the posting, making available or creation of any file or posting by a User on the Website or any action taken by a User on the Website. The User understands that he/she cannot make any claim against the Operator in this regard.
   2. The Operator shall not be liable for any impossibility or limitation of use of the Website caused by malfunctions of the Internet network, as well as other circumstances of a technical nature. The User acknowledges that access to the Website may be restricted or interrupted for technical or other reasons.
   3. The Operator shall only be liable for such loss of data caused by its own activity, but shall not be liable for the loss of the User’s data.
   4. The Operator is entitled to restrict or terminate the User’s access to the Website in the event of any breach of these Terms by the User. The Operator shall not be liable for any injury to the User caused by such interruption or termination of access to the Website and the User shall not be entitled to compensation for any injury suffered by the User as a result of such interruption.
   5. The Operator shall be liable for any unauthorized interference of third parties, as a result of which such persons unlawfully gain access to the personal data of Users or to the relevant database of Users and use, exploit, misuse or disclose such data to third parties only if the Operator has breached any of its obligations under these Terms and Conditions. Otherwise, the Operator shall not be liable and shall not be obliged to compensate for damages.
   6. The User shall bear all legal consequences that arise as a result of a breach of the User’s obligations under these Terms and Conditions or obligations set forth by generally binding legal regulations. The User shall furthermore be obliged to pay the Operator all costs and expenses incurred as a result of third party claims against the Operator as a result of any breach of obligation by the User.
   7. The User is not entitled to hold the Operator liable in any way for any third party legal claims arising out of or in connection with the use of the Website.
      
      
7. Website
   1. The Website is the exclusive property of the Operator and the Operator is entitled to exclusively exercise all rights to the Website.
   2. The Operator reserves the right to determine the manner of graphic display of the Website and other Internet applications operated by it and to change, modify or supplement this manner at any time. When using the Website, the User is obliged to follow the relevant instructions within the interface of the Website, unless such instructions are not set out in these Terms.
   3. The Operator will actively try to prevent any technical problems, but cannot guarantee 100% availability of the Website.
   4. In accordance with the Copyright Act, the Operator is entitled to exercise property rights to the Website. The content of the Website, with the exception of uploads and contributions of Users on the Website, may not be stored, modified or distributed without the Operator’s consent. Any use of the content of the Website, or parts thereof, by the User in a manner other than for the purposes for which the Website is intended, in particular any unauthorized distribution of the content, with the exception of the uploads and contributions of Users on the Website, is prohibited. Any interference with the technical or factual content of the Website is prohibited. The User acknowledges that any unauthorised interference with the Website or unauthorised use of any rights associated with the Website (in particular copyright) may cause the Operator damages which will be claimed against the User.
   5. Trademarks, logos, graphics, images, photographs, animations, videos and text appearing on the Website may not be reproduced, used, published, distributed, sold or displayed without the prior written permission of the Operator. The logos and trademarks of online casinos, gambling providers and payment providers are subject to the intellectual property rights of the respective operators of such casinos, gambling platforms and payment services. The Operator publishes these logos and trademarks on the Website for the sole purpose of referring to the services provided by the respective trademark owners (reasonable use policy).
      
      
8. Announcements
   1. Any notification, request or other communication to the Operator shall be made only by e-mail communication to the Operator’s e-mail address.
   2. Any notice, request or other communication to the User shall be made by e-mail to the User’s e-mail address or by posting on the Website in a section accessible to the User.
   3. A notice, request or other communication will always be deemed to have been delivered if made by any of the above methods.
      
      
9. Final provisions
   1. The contractual relationship established between the Operator and the User is governed by the Civil Code. In case of mutual conflict, these Terms and Conditions shall prevail over the dispositive provisions of the Civil Code.
   2. The Personal Data Processing Terms and Conditions form an integral part of these Terms and Conditions, although they are set out in a separate document.
   3. Any proposal to change the Terms by the User must be accepted unconditionally by the Operator, otherwise it is not eligible to change these Terms.
   4. The User acknowledges that he/she has read these Terms and the provisions in the relevant sections of the Website to which these Terms refer, fully understands them and agrees to all the rights and obligations contained in these Terms and the provisions in the relevant sections of the Website to which these Terms refer.
   5. The Operator is entitled to unilaterally change these Terms and Conditions by notifying you on the Website. Upon notification of a change to the Terms, the change to the Terms becomes binding on the User.
   6. The ineffectiveness or invalidity of any provision of these Terms shall not render them ineffective or invalid.
   7. These Terms and Conditions come into force and effect on 1.3.2020
